Leading beverage giants Coca-Cola, Danone, and Nestle have found themselves in hot water over alleged misleading claims about their plastic water bottles being “100% recycled.” A consumer body and two environmental groups have jointly issued a legal complaint to the European Commission, accusing the companies of greenwashing, a practice where brands exaggerate their eco-friendliness to deceive consumers. They argue that the plastic bottles supplied by these companies are never made entirely of recycled materials, contrary to their claims.

Challenging Misleading Claims
The European Consumer Organisation, along with the support of environmental groups Client Earth and ECOS, claims that the companies' assertions that their single-use plastic water bottles are either 100% recycled or 100% recyclable are deceptive, especially when accompanied by green imagery or branding. The complainants argue that these bottles are never made wholly of recycled materials, and their recyclability depends on various factors, including available infrastructure.

Rosa Pritchard, a plastics lawyer at ClientEarth, stated, “The evidence is clear – plastic water bottles are simply not recycled again and again to become new bottles in Europe.” She emphasised that a “100%” recycling rate for bottles is technically unattainable and that using recycled plastic in bottle production does not absolve them from harming the environment.

Company Responses
Coca-Cola responded to the allegations by stating that it is actively working to reduce its plastic packaging usage while investing in collecting and recycling equivalent packaging. The company claims that its packaging messages are based on verifiable facts, with relevant qualifications displayed to enable consumers to make informed choices.

Nestlé, another accused company, highlighted its efforts to reduce plastic packaging use, invest in packaging circularity, and communicate transparently with consumers. It reported a 10.5% reduction in virgin plastic packaging since 2018 and aims to achieve a one-third reduction by the end of 2025.

Danone affirmed its commitment to packaging circularity, vowing to continue investing in better collection and recycling infrastructure alongside its partners.

Possible Consequences
If the European Commission sides with the complaint, it can coordinate a collective response involving national consumer authorities that can take subsequent actions. These actions may include requiring companies to rectify the situation or imposing fines within their respective territories. The European Commission does not have the authority to levy penalties on its own.

The accusations against these beverage giants underscore the importance of transparent and accurate environmental claims in an era where consumers increasingly seek eco-friendly choices and hold companies accountable for their environmental impact.
