Mike Lynch’s Estate Ordered to Pay HPE in Wake of Autonomy Acquisition Scandal
The High Court has held that the estate of the late technology magnate Mike Lynch, alongside his business partner, must pay in excess of £700 million to Hewlett Packard Enterprise (HPE). The verdict emanates from the contentious acquisition of Lynch's company, Autonomy, by HPE in 2011, a deal mired by allegations of financial misrepresentation.
HPE contended that Lynch and Autonomy's ex-financial chief, Sushovan Hussain, embellished the firm's financial health, leading to HPE overpaying. The court concurred, stating HPE compensated above the odds due to the financial misstatements.

A statement prepared by Lynch prior to his untimely demise criticised HPE's original demand for up to £3.7 billion as excessively inflated.
The adjudication was postponed following Lynch and his daughter Hannah's tragic deaths last August. Their yacht, the Bayesian, capsized and sank near Sicily amidst a severe storm, claiming their lives along with five others.
The presiding judge expressed his condolences over the tragic incident, noting his respect for Lynch despite the final judgement.
HPE has welcomed the decision, viewing it as a pivotal step towards resolving this longstanding dispute, and anticipates a forthcoming hearing to finalise the damages.
The crux of the dispute lies in HPE's accusation that Lynch and Hussain artificially boosted Autonomy's value before its £7.1 billion sale in 2011, a transaction that netted Lynch around £500m. HPE had to subsequently write down Autonomy's value by £6.7 billion, attributing it to grave accounting irregularities uncovered post-purchase – claims staunchly denied by Lynch and Hussain.
In a notable turn of events, Hussain was found guilty of fraud related to the sale in the US in 2018 and sentenced to five years' incarceration.
A UK judgement in 2022 found in favour of HPE, though it suggested the tech giant would likely receive much less than the £3.7 billion it sought. Despite being extradited to the US in 2023 on fraud charges, Lynch was acquitted in 2024, a vindication that was short-lived due to the subsequent yacht tragedy.
Lynch, defending Autonomy's valuation and the English civil case's reliance on unchallenged hearsay from the US, queried the English legal system's credibility.
A hearing set for November will deliberate on the possibility of Lynch's estate appealing the recent ruling and how the ordered payments to HPE will be apportioned between the Lynch estate and Hussain, who has already reached a settlement with HPE earlier this year.
