Legal Battle Against Qualcomm Could Mean £17 Each for Millions of Apple and Samsung Buyers in the UK

In a landmark legal challenge, around 29 million British consumers who purchased an Apple or Samsung smartphone from 2015 to 2024 could each be set for a potential payout of approximately £17. This comes as the consumer advocacy group, Which?, takes on the American technology behemoth Qualcomm at the Competition Appeal Tribunal in London.

The case, slated to unfold over five weeks starting Monday, centres on allegations made by Which? against Qualcomm, accusing the chip-making titan of engaging in anti-competitive behaviour. The crux of Which?'s argument is that Qualcomm allegedly coerced Apple and Samsung into paying over-the-odds prices for vital mobile components. This, the consumer group argues, resulted in higher smartphone prices for the end consumers.

The Reporters has sought a response from Qualcomm concerning the allegations.

At the heart of the trial is the determination of Qualcomm's market dominance and whether it exploited its position to the detriment of market competition and consumer interests.

Should Which? triumph in this legal battle, a subsequent phase will be initiated to claim £480 million in damages from Qualcomm. This sum is intended to be redistributed among the estimated 29 million affected UK smartphone purchasers. The average compensation figure is pegged at around £17 per individual.

Qualcomm has dismissed the lawsuit, asserting it is without merit. However, the case reflects a wider issue, with Qualcomm facing similar legal scrutiny in Canada and having previously been penalised by the European Union for antitrust violations.

Anabel Hoult, Chief Executive of Which?, underscored the significance of the trial, viewing it as a pivotal moment that demonstrates the collective power of consumers to challenge major corporations accused of monopolistic practices.

Qualcomm, a leading global supplier of smartphone chips, is no stranger to allegations of anti-competitive conduct. In 2017, the U.S. Federal Trade Commission took legal action against the company for its licensing practices, although the case was eventually dismissed in 2020.

As the trial commences, the outcome could set a precedent for how large tech entities are held accountable for their market practices in the UK and beyond.
